Welcome to Emosion. These Terms of Service (“Terms”) govern your access to and use of the Emosion application (the “App” or “Service”), including Android, desktop, and web editions where available. The Service is engineered and operated by Anyfinite.
By downloading, installing, accessing, or using Emosion, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not install or use the Service.
Essential Requirement
You must be at least 18 years old to use Emosion. The App may include romantic or adult companion personas and is not intended for or marketed to minors.
1. Eligibility
You must be at least 18 years of age to use Emosion. By creating an account, selecting a companion, or entering a voice call, you represent and warrant that you meet this age requirement and possess the legal capacity to enter into these Terms.
2. License to Use
Anyfinite grants you a personal, revocable, non-exclusive, non-transferable, non-sublicensable, limited license to install and run the App on your authorized personal devices in accordance with these Terms. All rights not expressly granted are reserved by Anyfinite.
3. Accounts, Guest Mode, and Security
You may use Emosion without an account in Guest mode (where your companions and conversations remain exclusively on your local device), or create an account to enable multi-device encrypted cloud synchronization and access paid companion benefits. You are responsible for keeping your credentials confidential and for all activity occurring under your account. You agree to notify us immediately of any suspected breach.
4. Acceptable Use
You agree to use Emosion lawfully and respectfully. You strictly agree NOT to:
- Generate, solicit, or share illegal, sexually exploitative, or abusive material
- Attempt to generate content involving minors in any exploitative context (zero tolerance)
- Reverse engineer, decompile, scrape, or flood the App, APIs, or connected speech infrastructure
- Harass, threaten, defame, impersonate, or defraud any individual or organization
- Circumvent or tamper with feature gating, credit counters, or encryption mechanisms
We reserve the right to suspend or terminate accounts immediately for violations of this section.
5. AI Companions and Disclaimers
Emosion companions are powered by artificial intelligence models. Companions are not human beings. While engineered for warm, nuanced, and empathetic conversation, AI responses may occasionally be inaccurate, incomplete, or unpredictable. Companions generate synthetic dialogue intended solely for creative conversation, entertainment, and digital companionship. Anyfinite disclaims all liability for any personal decisions, real-world actions, financial choices, or emotional distress resulting from conversational interactions with AI companions.
Not a Healthcare or Emergency Substitute
Emosion does not provide medical, psychiatric, psychological, legal, or emergency intervention. If you are experiencing a crisis, emergency, or distress, please immediately contact your local emergency helpline or a qualified professional.
6. Plans, Billing, and Refunds
Emosion offers a Free tier with welcome voice credits and daily starter messages, along with optional paid subscription tiers (Weekly, Monthly, Annual). Plus includes an extended daily fair-use chat allowance.
- Platform Billing: Android subscriptions and credit top-up transactions are processed securely through Google Play under its billing policies.
- Credit Refresh & Expiration: Weekly and Monthly voice credits refresh after each verified renewal. Annual subscriptions are billed yearly but receive 40 credits on each monthly anniversary. Plan credits do not roll over. Plus-only top-up packs never expire and stay in your account until used.
- Cancellations: You can manage and cancel auto-renewing subscriptions at any time via your app store account settings. Cancellation takes effect at the conclusion of the current prepaid billing period.
- Refunds: Digital voice credits activate immediately after server verification. Refunds and revocations follow Google Play policies and may remove unused access or credits associated with the refunded purchase.
7. Your Content, Privacy, and Client-Side Encryption
You retain full ownership of the custom companions, chat messages, and memories you create. We recognize that personal thoughts shared with companions demand total confidentiality.
Emosion incorporates client-side AES-256-GCM encryption. Private messages and memories are encrypted directly on your physical device prior to cloud transmission, ensuring your personal memories and conversation history remain encrypted at rest.
You grant Anyfinite a limited, non-exclusive license to process your content solely as required to operate the Service (such as delivering companion dialogue, speech synthesis, and secure cloud synchronization). We do not monetize or sell your personal conversations.
8. Intellectual Property
The Emosion brand, app designs, visual assets, audio routines, software code, and documentation are the exclusive property of Anyfinite and its licensors, protected by copyright, trademark, and trade secret laws.
9. Third-Party Services
The App interfaces with third-party service providers (such as Supabase, Google Cloud, and Firebase). While chosen for high availability and reliability, Anyfinite is not liable for temporary third-party network outages beyond our reasonable control.
10. Disclaimer of Warranties, Data Storage & Security
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, or non-infringement.
Data Loss & Storage Safeguards: While Emosion utilizes robust local SQLite database persistence and multi-device cloud synchronization, electronic data is inherently subject to hardware failure, device resets, operating system upgrades, and unexpected storage corruption. Anyfinite does not warrant that your conversational history, companion memories, or custom settings will remain permanently intact, uncorrupted, or retrievable. Anyfinite is not liable for data loss or corruption resulting from device resets, application uninstallation, cache clearing, or personal hardware malfunctions.
Security Breaches & Third-Party Threats: Anyfinite incorporates client-side AES-256 encryption and hardware-backed key protection to safeguard your privacy. However, no internet transmission or electronic vault is 100% impenetrable. To the maximum extent permitted by applicable law, Anyfinite disclaims liability for unauthorized access, interception, or security breaches arising from circumstances beyond our reasonable commercial control, including but not limited to compromised user devices, stolen account credentials, device malware, or vulnerabilities in third-party operating systems and infrastructure.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Anyfinite, its founders, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, goodwill, or emotional distress. In all events and under all legal theories, Anyfinite's total cumulative aggregate liability arising out of or related to Emosion shall not exceed the amount actually paid by you to Anyfinite in the three (3) months preceding the incident or INR 2,000, whichever is greater.
12. Account Termination
You may terminate your account at any time through Profile settings. Account deletion permanently erases your cloud records, encrypted companion memories, and authentication identity. Anyfinite may suspend or terminate your access for violation of these Terms or prolonged inactivity.
13. Changes to These Terms
We reserve the right to modify or replace these Terms periodically to reflect enhancements to our AI models, security features, platform rules, or regulatory requirements. We will indicate revisions by updating the “Effective Date” at the top of this document, and where changes are material, we may provide in-app notification. By continuing to access or use Emosion after revisions become effective, you agree to be bound by the updated terms. If you do not agree to the updated terms, your sole remedy is to cease using the App.
14. Governing Law and Exclusive Venue
These Terms and any dispute, controversy, or claim arising out of or relating to Emosion or Anyfinite shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
You expressly agree that the competent courts located in New Delhi, India shall have exclusive jurisdiction over all disputes, suits, or proceedings arising under or related to the App or these Terms. You hereby irrevocably waive any objection to the venue of such courts or any claim of an inconvenient forum.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted solely on an individual basis and not in a class, consolidated, or representative action.
Mandatory Informal Resolution: Before initiating any formal legal or regulatory proceeding, you agree to attempt in good faith to resolve the dispute informally by providing written notice to Anyfinite at support@anyfinite.com and allowing a thirty (30) day resolution period.
